Delivery.gi Terms & Conditions

Last Updated: 13 th October 2025 Important Notice:

These Terms & Conditions govern all services provided by Delivery.gi to private and business customers. By using our website or engaging our services, you confirm that you have read, understood, and agree to be bound by these Terms. They set out your rights and obligations, as well as those of Delivery.gi, in relation to the ordering, transportation, customs clearance, and delivery of goods.

1. Introduction & Acceptance

This website and service is operated by Delivery.gi (“Delivery.gi”, “we”, “us”, “our”) and these Terms & Conditions, together with any referenced documents such as our Privacy Policy, govern your use of our website and services.

By accessing or using this website or placing an order through us, you (“you”, “your”, “Customer”) agree to be bound by these Terms & Conditions.

If you disagree with any part of these Terms & Conditions, you must not use our services.

2. Eligibility & Use Limitations

This website is intended for users who are 18 years old or above. By using the site, you confirm that you are at least 18 years of age.

You may use the site only for lawful purposes and in accordance with these Terms & Conditions.

3. Service Description

Delivery.gi acts as a broker between you and the retailer or supplier from whom you wish to purchase goods. Our role is to facilitate your order, manage logistics, customs clearance, and final delivery. We are not the supplier or manufacturer of the goods.

When you place an order via Delivery.gi, we will:
i. Submit your order to the retailer or supplier
ii. Arrange collection of the goods
iii. Manage transport to Gibraltar
iv. Handle customs clearance, import duties, and taxes
v. Arrange delivery to your home or specified address

4. Orders, Pricing & Payment

You must provide accurate details for the goods you wish to purchase, such as reference numbers, links, and quantities.

Once you submit your request, we will issue a quotation including all costs. You must accept and pay that quote before we proceed.

The total charge we quote you will be inclusive of our service fee, which covers:
i. The product cost (retail price)
ii. Import duties, taxes, and customs fees
iii. All transport, handling, and delivery costs

Our standard service fee is 20% of the total value of the order, subject to a minimum service fee of £10 (or the Euro equivalent), regardless of order value.

Payment must be made by the methods we specify (such as bank transfer or card payment). We will not proceed with purchasing goods until full payment is received.

All quotes and prices are in GBP or EUR, as applicable. We may apply the prevailing exchange rate if needed.

5. Order Fulfilment, Delivery & Timing

After payment, we aim to purchase and dispatch your order within two working days.

Delivery times vary depending on the retailer and country of origin. As a general guide:
i. Orders from Spain typically arrive within up to seven working days.
ii. Orders from the United Kingdom typically arrive within up to ten working days.
These estimates may vary based on courier schedules, customs processing times, or retailer dispatch delays.

If an item becomes unavailable after you place your order, we will notify you promptly. We may offer an alternative or refund that portion.

Partial deliveries may occur where part of your order is ready before the rest.

Risk of loss or damage during transit to Gibraltar lies with the retailer until delivery to you. Once goods are delivered, responsibility passes to you.

Uncollected goods may incur a storage fee of £15 per day.

6. Inspection, Defects & Reporting

We inspect all goods upon arrival at our facility for visible external damage.

It is your responsibility to notify us in writing of any defects, damages, discrepancies, or missing items within 24 hours of receiving the goods. If you fail to do so within this time frame, Delivery.gi will not accept liability for any issues thereafter.

In cases where defects are verified, our liability is limited to the original cost of the goods. We are not liable for consequential losses, incidental damages, or loss of use beyond the purchase price.

7. Returns, Refunds & Cancellations

Because we act as a broker, Delivery.gi does not directly facilitate returns or refunds in most cases. These are typically managed between you and the retailer or supplier.

If you wish to return or refund an item, you may choose either of the following options:
i. We can provide you with a quote to manage the return or refund process on your behalf; or
ii. We can provide you with copies of all relevant documentation (invoices, order receipts, and shipping records) so that you may manage the process directly with the retailer or supplier.

If your order has already been placed with the retailer, cancellation may not be possible and could incur an administrative cancellation fee.

Costs associated with returns, such as shipping, customs, and restocking fees, will typically be borne by you unless otherwise agreed.

8. Limitation of Liability & Disclaimers

To the fullest extent permitted by law, Delivery.gi and its officers, employees, and agents exclude all liability for:
i. Indirect, incidental, or consequential damages
ii. Loss of profit, revenue, business, or goodwill
iii. Delays or failures beyond our reasonable control

Our maximum aggregate liability under these Terms shall not exceed the total fees you paid to us for the relevant order.

We do not guarantee uninterrupted or error-free access to the website.

We are not liable for delays or failures caused by circumstances beyond our control, including but not limited to natural disasters, strikes, government actions, shipping disruptions, customs delays, or pandemics.

9. Intellectual Property & Website Use

All content, designs, logos, and trademarks on this website are owned by or licensed to Delivery.gi. You may not reproduce, copy, modify, or distribute any content without our prior written consent.

You agree not to use the website or our services in any way that is unlawful or that interferes with others’ use of the service.

10. Data Protection & Privacy

Our Privacy Policy explains how we collect, use, store, and protect your personal data. By using our website or placing an order, you agree to that policy.

We may share necessary data with retailers, customs authorities, couriers, and other third parties only to the extent required to fulfil your order.

11. Customs & Import Compliance

While Delivery.gi handles customs clearance, we are not responsible for import refusals, delays, or additional charges arising from issues with the retailer’s documentation or local customs rules.

Any duties or taxes that change after your order has been placed will be your responsibility.

12. Disputes, Governing Law & Jurisdiction

These Terms & Conditions are governed by the laws of Gibraltar.

Any disputes arising under or in connection with these Terms shall, where possible, first be resolved amicably through discussion or mediation.

If a resolution cannot be reached, the matter shall be submitted to the exclusive jurisdiction of the courts of Gibraltar.

13. Miscellaneous

Severability: If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Waiver: Our failure to enforce any right or provision under these Terms does not constitute a waiver of that right or provision.

Notices: Any formal notices must be sent to our registered address or through the contact methods stated on our website.

Assignment: You may not assign your rights under these Terms without our prior written consent. We may assign or subcontract our rights or obligations at our discretion.
